Russian Golden Visa: who can apply?

As of January 11 2023 Russia has joined the club of countries that offer foreign investors a residency by investment.

Under the proposed regime of investment foreign investors will have the following benefits:

• Foreign investor will skip the necessity of obtaining a quota for temporary residency and obtaining temporary residency itself, but will instead directly apply and obtain permanent residency
• Obtaining a lifelong residency for the investor and their family members – spouse, children, parents, spouse's parents, grandparents, and grandchildren
• No requirement to reside in Russia for the investor or family members
• No requirement to pass the Russian language test
• Eligibility to apply for citizenship after 5 years as a legal resident

Criteria:

1. During the 3 years preceding the application for a residence permit, made investments into the socially significant projects of the subjects of the Russian Federation in the amount of at least 15 million rubles.
2. Registered a legal entity in the form of an economic partnership, limited liability company, joint-stock company with a sole founder, farm, or business partnership within the territory of the Russian Federation, and this legal entity carries out business activities for 2 years immediately preceding the calendar year in which a foreign citizen applies for a residence permit. At the time of filing the application, the legal entity must continue to carry out business activities.

Important:

• at the time of the decision to issue a residence permit, a foreign citizen must be the sole founder of a joint-stock company or a limited liability company
• the amount of taxes and fees, as well as contributions to extra-budgetary funds, should be at least 4 million rubles annually

3. Made investments in the amount of at least 30 million rubles into a Russian legal entity that has been carrying out entrepreneurial activity on the territory of the Russian Federation for at least 3 years in the form of an economic partnership, a limited liability company, a joint-stock company, a farm, or a business partnership.

4. Acquired on the territory of the Russian Federation on the right of ownership (shared ownership) of real estate objects of any purpose at the construction stage or within 2 years after their commissioning and owns them continuously for 1 year until the date of applying for a residence permit.

Important:

• the total cadastral value of objects belonging to a foreign citizen should be at least 50 million rubles in Moscow, at least 20 million rubles within the territories of the subjects of the Far Eastern Federal District, at least 25 million rubles within the territories of other subjects of the Russian Federation
• there should be no restrictions on rights and encumbrances on objects within 1 year before applying for a residence permit.
