On March 31, the RAUIE Mediation Center, together with the Presidential Commissioner for Entrepreneurs’ Rights and the Russian-Chinese Committee for Friendship, Peace and Development held a round table "Mediation with China: solution of the topical issues"
The experts of the event were Aleksey Ryabov, Head of the Expert and Legal Center of the Presidential Commissioner for Entrepreneurs’ Rights, Elena Gizerskaya, Head of the RAUIE Mediation Center, Oksana Kozhevnikova, professional mediator of the RAUIE for corporate / business disputes, corporate lawyer in the field of consulting and Ekaterina Prokhorova , lawyer, head of legal practice, mediator.
The meeting began with a welcoming speech by Alexei Ryabov, Head of the Expert and Legal Center of the Presidential Commissioner for Entrepreneurs’ Rights, as well as the public ombudsman for mediation development. “Over the entire period of almost 10 years of work of the Ombudsman Institute, the appeals to us from Chinese entrepreneurs were of an exclusively one-time nature. In our understanding, their attitudes are to not deduce the negotiation process into legal procedures, in any case not to sue, especially with the Governement. It is important to understand the development vector of mediation associated with Chinese business, the prospects for its development with Chinese entrepreneurs,” said Alexey Ryabov.
Oksana Kozhevnikova made a presentation: “What support measures are exist and where to look for them?”. The criteria and conditions of 4 preferential lending programs for SMEs, preferential loans for Moscow SMEs, “Credit holidays”, “Test holidays”, renewal of licenses / permits, tax benefits, preferences for the IT sector, support for the construction industry, support for state land tenants were highlighted. “The reality of entrepreneurs today is lightning-fast changes in legislation, ambiguous interpretation and incomprehensible implementation, lack of established practice. Elena Gizerskaya presented in detail: "Rules of correspondence when conditions change." Elena recalled the important criteria for correspondence in the new conditions, such as the absence of claims, customer care, loyalty, and the search for mutual interests. Clarifications were given on what to do if buyers are afraid to send money, although our banks work as usual.
The experts in their reports tried to group the most relevant and frequent questions of the participants, and also gave their advice on the questions asked during the event.z
